Evaluating the compliance of mineral fertilizers and mineral plant aids with the national fertilizer law1), (registration documentation), issuing opinions on compliance with quality requirements and impurity content.
Legal basis:
1) Law on Fertilizers and Fertilization of July 10, 2007 (Journal of Laws 2024, item 105);
- Order of the Minister of Agriculture and Rural Development dated August 9, 2024.
On the implementation of certain provisions of the Law on Fertilizers and Fertilization (Journal of Laws 2024, item 1261); - Regulation of the Minister of Economy of September 8, 2010 on the way mineral fertilizers are packaged, the placement of information about fertilizer components on these packages, the way mineral fertilizers are tested and the types of fertilizer lime (Journal of Laws of 2010 No. 183 item 1229).
Domestic marketing of mineral fertilizers and mineral plant boosters
If a mineral fertilizer or crop support agent meets national requirements for quality and impurity content, it may be marketed on the basis of an authorization from the Minister of Agriculture or an authorization obtained in another country of the European Union.
Permits require, among other things:
- Test report on fertilizer or crop support product conducted by authorized or accredited units – §4 of the Ordinance of the Minister of Agriculture and Rural Development (Journal of Laws 2024, item 1261).
Note: Testing shall be carried out taking into account §3 of the aforementioned regulation, on a product sample taken by an employee of a district chemical and agricultural station or a unit accredited for sampling.
- Opinion on compliance with quality requirements and permissible values of contaminants prepared by Łukasiewicz – New Chemical Syntheses Institute in Puławy.
- Opinion on suitability for use according to purpose:
- in field crops, grasslands and for reclamation – Institute of Fertilization and Soil Science – PIB
- in orchard and floriculture – Institute of Horticulture in Skierniewice on permanent grassland – Institute of Technology and Life Sciences in Falenty
- in forests – Forest Research Institute in Warsaw
- Draft instructions for use and storage of fertilizer (Article 4 paragraph 4 item 3 of the Law on Fertilizers and Fertilization, OJ. 2024, item 105, and §12 of the Ordinance of the Minister of Agriculture and Rural Development, OJ. 2024, item 1261).
- In order to obtain an opinion on compliance with the quality requirements and permissible values of contaminants in a mineral fertilizer or crop support agent, prepared by Łukasiewicz – INS, it is necessary to provide:
- Commissioned to develop an opinion.
- Test results conducted by authorized or accredited bodies confirming:
- declared nutrient content, physical, physicochemical and chemical parameters, as well as compliance with minimum quality requirements and permissible values of impurities – in the case of fertilizers;
- declared physical, physicochemical and chemical parameters, as well as compliance with minimum quality requirements and permissible values of impurities – in the case of crop support products.
- Manufacturer’s or importer’s declaration.
- Draft instructions for the application and storage of fertilizer, soil conditioner or growth promoter.
- Safety data sheet for fertilizer, soil conditioner or growth promoter.
