The processing of personal data by \u0141ukasiewicz &#8211; INS is carried out in accordance with Regulation (EU) 2016\/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95\/46\/EC (General Data Protection Regulation), hereinafter referred to as &#8220;RODO&#8221;, the Act of May 10, 2018 on the protection of personal data and other generally applicable laws. The primary objective of \u0141ukasiewicz &#8211; INS in the context of personal data processing is to protect the fundamental rights and freedoms of individuals in connection with the activities of processing their data.    <\/p>\n<h2>Information clause<\/h2>\n<p>According to the content of Article 13 and Article 14 of RODO \u0141ukasiewicz &#8211; INS is obliged to provide information in case:  <\/p>\n<ol>\n<li>collection of data from the data subject;<\/li>\n<li>obtaining personal data by means other than from the data subject.<\/li>\n<\/ol>\n<p>Based on Article 12 (1) of the RODO, this information is provided by \u0141ukasiewicz &#8211; INS in a concise, clear, understandable and easily accessible form, in clear and simple language. Information on the processing of personal data is provided by \u0141ukasiewicz -INS in writing, including electronically. Bearing in mind Article 12(5) of the RODO, \u0141ukasiewicz -INS does not charge for providing information under Articles 13 and 14 of the RODO. For example: <\/p>\n<ol>\n<li>if you contact us, we use your data so that we can respond to you;<\/li>\n<li>if you conclude a contract with us then your data will be used for the preparation and subsequent execution of the contract;<\/li>\n<li>if you are a participant in our trainings then we need your data in order to conduct these trainings properly;<\/li>\n<li>if we process your data in connection with the implementation of EU projects, we do so in order to fulfill our obligations as a beneficiary of such a project;<\/li>\n<li>if you are our employee then we will use your data to fulfill our obligations as an employer.<\/li>\n<\/ol>\n<h3>LEGAL BASIS FOR PROCESSING PERSONAL DATA<\/h3>\n<p>As a controller, we always process personal data based on the legal grounds indicated in the RODO. These bases may be: <\/p>\n<ol>\n<li>The consent of the data subject;<\/li>\n<li>performance of a contract to which the data subject is a party, or taking action at the request of the data subject prior to entering into a contract;<\/li>\n<li>Fulfillment of a legal obligation incumbent on the controller;<\/li>\n<li>Protecting the vital interests of the data subject or other individuals;<\/li>\n<li>performance of a task carried out in the public interest or in the exercise of public authority entrusted to the administrator;<\/li>\n<li>pursuing purposes arising from legitimate interests pursued by the controller. If we process personal data for purposes arising from the legitimate interests pursued by the controller, these interests may be the assertion and enforcement of claims, direct marketing and other forms of marketing or advertising, ensuring physical security (e.g. using monitoring), IT and network security. <\/li>\n<\/ol>\n<p><strong>INFORMATION ON RECIPIENTS OF PERSONAL DATA<\/strong><\/p>\n<p>It happens that in certain situations we transfer your personal data to other recipients. This can happen when a service we use requires it (e.g. IT, financial, insurance, auditing, courier and postal services, destruction and archiving of documentation, legal services). Each time we share your personal data with a recipient, it is done in accordance with the provisions of the RODO.  <\/p>\n<p><strong>TRANSFER OF PERSONAL DATA TO A THIRD COUNTRY OR INTERNATIONAL ORGANIZATION<\/strong><\/p>\n<p>Normally, we do not transfer your personal data to a third country or international organization. However, if such a transfer does occur, it is always in accordance with the provisions of the RODO. <\/p>\n<p>\u0141ukasiewicz &#8211; INS uses Microsoft Office 365, which may result in the transfer of your personal data to a third country. The Terms and Conditions for the use of MS Office 365 Online Services and the obligations with respect to the processing and safeguarding of user data and personal data by online services are set forth in Microsoft documentation. <\/p>\n<h3>THE PERIOD FOR WHICH PERSONAL DATA WILL BE KEPT<\/h3>\n<p>We keep your personal data until the purpose for which the processing is carried out by us. Sometimes the processing period is also due to legal regulations. <\/p>\n<h3>YOUR RIGHTS<\/h3>\n<p>As we process your personal data, you have the right to request from us access to your personal data, rectification, erasure or restriction of processing, the right to object to processing, and the right to data portability. To exercise your rights, please contact us. You need to know that the RODO regulates in detail when you can exercise your rights. As a controller, we always analyze whether there are grounds for you to exercise your rights.   <\/p>\n<h3>WITHDRAWAL OF CONSENT<\/h3>\n<p>If we process personal data on the basis of your consent then remember that you have the right to withdraw it. Withdrawal of consent will not affect the fact that we could use your personal data for the entire period of consent. <\/p>\n<h3>COMPLAINT TO THE PRESIDENT OF THE UODO<\/h3>\n<p>A person whose data is processed has the right to lodge a complaint related to the processing of his\/her personal data to the President of the Office for Personal Data Protection (address: 1A Moniuszki Street, 00-014 Warsaw).<\/p>\n<h3>OBLIGATION TO PROVIDE PERSONAL DATA<\/h3>\n<p>In cases justified by the specific purpose of processing, providing personal data may be a statutory or contractual requirement or a condition for entering into a contract. Your obligation to provide this data may also result from this. Moniuszki 1A, 00-014 Warsaw).<\/p>\n<h3>OBLIGATION TO PROVIDE PERSONAL DATA<\/h3>\n<p>Your obligation to provide this data may be:<\/p>\n<ol>\n<li>a statutory requirement,<\/li>\n<li>contractual requirement,<\/li>\n<li>a condition of the agreement.<\/li>\n<\/ol>\n<p>Remember that if you do not provide your personal data in certain situations, it may be a violation of the law. PPL together with implementing acts, for the purposes related to the public procurement procedure to which the subject documentation relates and the conclusion of a contract as a result.   <\/li>\n<li>The scope of personal data required by generally applicable laws is defined in the Public Procurement Law and its implementing acts. Sensitive data &#8211; to the extent required by the provisions of the Public Procurement Law &#8211; may also be processed in the course of the proceedings. In addition, data resulting from the documentation of the proceedings are processed, in particular those necessary for the preparation and conclusion of the contract, i.e. name and surname, data identifying the subject and contact data.   <\/li>\n<li>Personal data is processed for the purpose of awarding a public contract, documenting the proceedings and executing the contract.<\/li>\n<li>The recipients of your personal data will be persons or entities to whom the documentation of the proceedings will be made available based on the provisions of the law, including Article 18 and Article 74(1) and (2) of the Public Procurement Law &#8211; for participants in the public procurement proceedings. After the completion of the proceedings, the documentation of the proceedings, including personal data, may be made available to anyone interested on the basis of the Act of September 6, 2001 on access to public information. This may result in the transfer of personal data outside the European Economic Area.      <\/li>\n<li>The Administrator uses Microsoft 365, which may result in the transfer of your personal data to a third country. The terms and conditions for the use of Microsoft 365 Online Services and the obligations with respect to the processing and safeguarding of your data and personal data by Online Services are set forth in Microsoft documentation. <\/li>\n<li>Your personal data will be stored (processed), in accordance with Article 78(1) of the PPL, for a period of at least 4 years from the date of completion of the contract award procedure in accordance with applicable legal requirements and concluded agreements (among others, for the implementation of projects co-financed from external funds).  <\/li>\n<li>The obligation for you to provide personal data directly concerning you is a statutory requirement specified in the provisions of the Public Procurement Law related to participation in the proceedings for the award of a public contract. The consequences of failing to provide certain data result from the PPL. <\/li>\n<li>With regard to your personal data, decisions will not be made by automated means pursuant to Article 22 of the RODO, and data is not profiled. <\/li>\n<li>You own:<\/li>\n<li>Pursuant to Article 15 of the RODO, the right of access to personal data concerning you; in accordance with Article 75 of the PPL, if a person whose personal data is processed by the Contracting Authority exercises the right referred to in Article 15(1)-(3) of the RODO, the Contracting Authority may require the person making the request to indicate additional information aimed at specifying the name or date of the completed contract award procedure;    <\/li>\n<li>Pursuant to Article 16 of the RODO, the right to correct your personal data; pursuant to Article 19(4) of the PPL, we inform you that the exercise of the right to correct or supplement referred to in Article 16 of the RODO by the data subject may not result in a change in the outcome of the contract award procedure or a change in the provisions of the public procurement agreement to an extent inconsistent with the Act;    <\/li>\n<li>Pursuant to Article 18 RODO, the right to request the controller to restrict the processing of personal data, subject to the cases referred to in Article 18(2) RODO; the right to restrict processing does not apply to storage, to ensure the exercise of legal remedies or to protect the rights of another natural or legal person, or for compelling reasons of public interest of the European Union or of a Member State; pursuant to Art. 19(4) of the PPL, we would like to inform you that in a procurement proceeding, the submission of a request for restriction of processing referred to in Article 18(1) of the RODO does not restrict the processing of personal data until the conclusion of such proceeding;       <\/li>\n<li>The right to lodge a complaint to the President of the Office for Personal Data Protection (ul. Moniuszki 1a, 00-014 Warsaw, tel. 22 531 03 00, fax. 22 531 03 01, <a href=\"https:\/\/uodo.gov.pl\/pl\/p\/kontakt\">https:\/\/uodo.gov.pl\/pl\/p\/kontakt<\/a> ), if you consider that the processing of personal data concerning you violates the provisions of RODO.   <\/li>\n<\/ol>\n<p>You are not entitled to:<\/p>\n<ol>\n<li>In connection with Article 17(3)(b), (d) or (e) of the RODO, the right to erasure of personal data;  <\/li>\n<li>The right to portability of personal data referred to in Article 20 of the RODO; <\/li>\n<li>Pursuant to Article 21 RODO, the right to object to the processing of your personal data, as the legal basis for the processing of your personal data <\/li>\n<\/ol>\n<p>is Article 6(1)(c) of the RODO.  <\/p>\n<p><strong>4) RODO information clause &#8211; contracts (for contractors)  <\/strong><\/p>\n<p>The administrator of the personal data is the \u0141ukasiewicz Research Network &#8211; New Chemical Syntheses Institute in Pu\u0142awy, with regard to the personal data of individuals representing the entity with which the contract\/agreement is concluded, as well as the data of persons implementing the contract\/agreement.<\/p>\n<\/p>\n<ol>\n<li>The Administrator can be contacted by phone at +48 81 473 14 00, by mail at: \u0141ukasiewicz Research Network &#8211; New Chemical Syntheses Institute al. Contact details of the Data Protection Officer: <a href=\"mailto:iod@ins.lukasiewicz.gov.pl\">iod@ins.lukasiewicz.gov.pl.<\/a> <\/li>\n<li>The personal data of the persons referred to in paragraph 1 will be processed by the Administrator on the basis of: <\/li>\n<\/ol>\n<p>&#8211; Article 6(1)(b) of the RODO &#8211; in order to fulfill contractual requirements (the need to dispose of data for the performance of a concluded contract\/agreement), <\/p>\n<p>&#8211; Article 6(1)(c) of the DPA &#8211; to comply with statutory requirements (the need for the Administrator to fulfill its legal obligations under the law),  <\/p>\n<p>&#8211; Article 6(1)(f) RODO &#8211; for the purpose of realizing the legitimate interests of the Administrator (establishing, asserting or defending claims or maintaining contacts between the parties for the purpose of concluding and performing a contract).  <\/p>\n<ol start=\"4\">\n<li>The scope of personal data processed may include: name, surname, telephone number, e-mail address, residential\/business address, employer&#8217;s name, position\/function or other data provided by the entity with which the contract\/agreement is concluded.<\/li>\n<li>We received personal data directly from you, from public records or from the entity with which the contract is concluded.<\/li>\n<li>Information about recipients of personal data or categories of recipients &#8211; public authorities authorized by law and entities providing services to the Administrator, among others. in the areas of:<\/li>\n<li>(a) implementation of the service of destruction and archiving of documentation,<\/li>\n<li>b) implementation of services supplying the Administrator with technical and organizational solutions ensuring efficient management (in particular, ICT service providers, equipment suppliers, courier and postal companies, entities cooperating in the development of publications and their distribution, entities operating social media);<\/li>\n<li>(c) implementation of legal, insurance, consulting services.<\/li>\n<li>The personal data of the persons referred to in paragraph 1 will not be transferred to a third country (understood as a country outside the European Economic Area) or an international organization within the meaning of the RODO, subject to the following. <\/li>\n<\/ol>\n<p>The Administrator uses Microsoft 365, which may result in the transfer of your personal data to a third country. The terms and conditions for the use of Microsoft 365 Online Services and the obligations with respect to the processing of securing your data and personal data through online services are set forth in Microsoft documentation, including in particular: <\/p>\n<ol>\n<li>(a) Privacy Statement <a href=\"https:\/\/www.microsoft.com\/pl-pl\/privacy\/privacystatement\">https:\/\/www.microsoft.com\/pl-pl\/privacy\/privacystatement;<\/a><\/li>\n<li>(b) Microsoft Services Agreement (MSA) &#8211; <a href=\"https:\/\/www.microsoft.com\/pl-pl\/servicesagreement\/\">https:\/\/www.microsoft.com\/pl-pl\/servicesagreement\/.<\/a><\/li>\n<\/ol>\n<p>Data entered into Microsoft 365 is processed and stored in specific geographic locations.
